John R. Epperson, Special Counsel

John R. Epperson is Special Counsel in the Environmental Law Department.  Mr. Epperson represents clients regarding a broad range of legal issues relating to environmental and occupational health and safety regulatory compliance counseling, including permitting, defense of enforcement actions, site investigations and remediation. 

His practice includes regulatory compliance and counseling in myriad facets of use of hazardous chemicals, including the areas of solid and hazardous waste, the Clean Water Act and the Clean Air Act, RCRA, CERCLA and state law equivalents, as well as federal and state OSHA and pipeline safety issues.  He has extensive experience with investigation and remediation of hazardous substances from soil and groundwater and associated cost recovery, as well as Brownfields redevelopment of such properties.  He has defended clients against enforcement actions by federal, state and municipal agencies, including writ practice challenging agency actions in court.  He has also assisted in the defense of OSHA citations, investigation of occupational accidents and response to whistleblower complaints under OSHA.  Mr. Epperson is also a member of the firm's Product Law practice and has significant experience with California's Proposition 65. 

Mr. Epperson also has substantial experience with transactions involving contaminated property, including performance of due diligence for acquisitions of properties and companies, as well as representation of sellers of contaminated assets.  He has also assisted clients in obtaining environmental insurance for such acquisitions and other environmental risks. 

Mr. Epperson is currently a member of the Executive Committee of the California State Bar Environmental Law Section and is a former Committee Vice-Chair for the ABA Superfund and Natural Resource Damages Litigation Committee.  Prior to entering law school, Mr. Epperson had over ten years of technical experience in radiation safety in the nuclear power industry.
